Terms of Service
These Terms of Service ("Terms") govern your access to and use of 8hour.app (the "Website") and the 8-Hour App boilerplate, source code, templates, documentation, and related digital content (collectively, the "Product").
In these Terms, "we", " us", " our" refer to Calipsio, located at 25 rue Vicq d'Azizr 75010 Paris, France. You can contact us at contact@calips.io.1. Acceptance of these Terms
By accessing the Website, purchasing, downloading, cloning, or using the Product, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree, do not use the Website or the Product.2. Effective date
These Terms take effect on the earlier of: (a) your first use of the Website, or (b) the date you purchase or otherwise receive access to the Product.3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract.4. Access, delivery, and security
4.1 Delivery. The Product is delivered digitally (for example via download links, private repository access, or similar).
4.2 Keys / invites. If access is provided through license keys, invitations, or credentials, you are responsible for keeping them confidential and for all activity under your access.
4.3 Unauthorized access. You must notify us promptly at contact@calips.io if you suspect unauthorized use.5. License
Subject to these Terms and your payment of applicable fees, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Product to design, build, test, and ship applications.
5.1 Unlimited apps. You may create and publish an unlimited number of applications using the Product, for personal or commercial purposes.
5.2 Internal sharing. You may share the Product internally with your employees/contractors solely as needed to build and maintain your applications, provided they do not further distribute the Product.6. Restrictions
You may not (and may not allow others to):
- Resell, redistribute, publish, or share the Product (in whole or in part), including by posting it to public repositories or file-sharing services.
- Offer the Product as a standalone product, a competing boilerplate, or as part of a template/boilerplate marketplace.
- Sublicense, rent, lease, or transfer access to the Product to any third party.
- Remove or obscure copyright, trademark, or proprietary notices included in the Product.
- Circumvent access controls or use the Product for unlawful or harmful purposes (including malware, spyware, or unauthorized data collection).7. Updates and support
7.1 Lifetime updates (all plans). All customers receive lifetime updates to the Product.
7.2 Meaning of "lifetime". "Lifetime" means for as long as we continue to maintain and distribute the Product. It does not guarantee that updates will be released on any particular schedule, nor that any specific feature will be maintained indefinitely.
7.3 Support. Any support, guidance, or community access is provided on a best-effort basis unless explicitly stated otherwise at checkout or on the Website.8. Fees, taxes, and payment processing
8.1 Pricing. Prices and included features may change over time. Changes will not affect prior purchases except where required by law (e.g., taxes).
8.2 Taxes. Prices may exclude VAT/GST/sales tax unless stated otherwise. You are responsible for applicable taxes except where we are required to collect them.
8.3 Payment providers. Payments may be processed by third-party providers (e.g., Stripe). Your use of those providers may be subject to their own terms.9. No refunds
All sales are final and we offer no refunds, except where required by applicable law.
Where applicable, by purchasing and receiving immediate access to the Product, you acknowledge that digital delivery begins immediately and you agree that any statutory withdrawal/cooling-off right may not apply or may be waived to the extent permitted by law.10. Third-party services
The Product may include integrations, references, or compatibility with third-party services (for example: hosting, authentication, analytics, payments, AI providers, databases). We do not control and are not responsible for third-party services. Your use of third-party services is governed by their own terms and policies, and you are responsible for compliance, billing, configuration, and security of any third-party accounts and keys.11. Your responsibilities
You are solely responsible for:
- Your use of the Product and the applications you build and publish (including compliance with App Store / Play Store policies).
- Any content, data, or user information processed by your applications.
- Security of your deployments, infrastructure, secrets, and API keys.
We are not responsible for your end products, operational decisions, or any user-generated content in your applications.12. Intellectual property
The Product (including source code, design, documentation, text, branding, and content) is owned by us and protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.13. Disclaimer
The Website and Product are provided "as is" and "as available". We make no warranties that the Product will meet your requirements, be error-free, uninterrupted, or that it will produce any particular results (including revenue or rankings). To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.14. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill arising out of or related to your use of the Website or Product.
- If we are found liable for any claim, our total aggregate liability will be limited to the amount you actually paid for the Product giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.15. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your applications or services built using the Product, (b) your violation of these Terms, or (c) your infringement or misuse of third-party rights or services.16. Suspension and termination
We may suspend or terminate your access and license immediately if you violate these Terms, engage in fraud/abuse/chargebacks, or if required by law. Upon termination, you must stop using the Product and delete copies you control. Sections that by their nature should survive (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.17. Changes to the Product
We may modify, update, or discontinue parts of the Website or Product at any time. If we discontinue the Product entirely, we do not guarantee continued access to hosted downloads or private repositories, but we will act reasonably where feasible.18. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will reflect the latest version. Continued use of the Website or Product after changes means you accept the updated Terms.19. Governing law and jurisdiction
These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms will be brought before the competent courts of Paris, France, unless mandatory rules provide otherwise.20. Contact
